A joint team\u00a0investigates possible violations that destroyed the\u00a0once rich peatland forest.<\/p>\n<p>In the middle of a vast, burned-down\u00a0forest littered with charred, blackened\u00a0tree trunks, Basuki Wasis instructs\u00a0one of his staff to stick a pipe\u00a0into the ground. One enters right\u00a0through and stops at a meter deep. A second\u00a0and then a third pipe sinks easily into\u00a0the swampland. The fourth sinks, and then\u00a0stops at just 40 centimeters deep.<\/p>\n<p>After taking ground samples, Basuki records\u00a0his fi ndings in a pocket notebook\u2014this was land with peat layers of 3.6 meters\u00a0deep. \u201cThis is evidence of a violation by\u00a0planting on peatland,\u201d Basuki told Tempo,\u00a0who accompanied the researcher from the\u00a0Bogor Institute of Agriculture (IPB) to the\u00a0burned swamplands, two weeks ago. \u00a0A researcher\u00a0from the IPB\u2019s laboratory for forest\u00a0ecological systems, Basuki instructed\u00a0his men to drill holes in six different locations across the peat swamp located within\u00a0Aloe Bateung Bruek village in Darul Makmur,\u00a0Nagan Raya regency of Aceh.\u00a0On this burned land controlled by palm\u00a0oil plantation company Kallista Alam, they\u00a0also gathered samples of charred trees\u00a0and mounds of ash. \u201cThis is further proof\u00a0to take Kallista Alam to court,\u201d said Bayu\u00a0Hardjanto, an investigator from the Ministry\u00a0of Environment.<\/p>\n<p>This land used to be the lush Tripa peatland\u00a0forest, located within the protected\u00a0Leuser Ecosystem, and referred to as the\u00a0country\u2019s lungs in the heart of the tsunamiplagued\u00a0Aceh province. Tripa used to teem\u00a0with one of the world\u2019s populations of critically-endangered Sumatran orangutans.<\/p>\n<figure id=\"attachment_6034\" aria-describedby=\"caption-attachment-6034\" style=\"width: 150px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/2014\/01\/A.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-6034 \" alt=\"Irwandi Yusuf. \" src=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/2014\/01\/A.jpg?resize=150%2C150&#038;ssl=1\" width=\"150\" height=\"150\" srcset=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/2014\/01\/A.jpg?resize=150%2C150&amp;ssl=1 150w, https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/2014\/01\/A.jpg?resize=200%2C200&amp;ssl=1 200w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><figcaption id=\"caption-attachment-6034\" class=\"wp-caption-text\">Irwandi Yusuf.<\/figcaption><\/figure>\n<p>Tripa had the largest and the most critical\u00a0capacity to store carbon in Aceh. A permit\u00a0to convert the peat swamp was issued\u00a0to Kallista Alam by the then Aceh Governor,\u00a0Irwandy Yusuf, on August 25, 2011\u2014three months following the issuance of a\u00a0map for protected forests, identifying Tripa\u00a0as a protected zone. The license granted\u00a0to Kallista involved 1,605 hectares of the\u00a0peat swamp.<\/p>\n<p>The indicative map of protected\u00a0forests was drawn\u00a0up in May 2011 and used\u00a0in line with a ban on\u00a0new clearing permits\u00a0for an area of about 60\u00a0million hectares of forests\u00a0and peatlands,\u00a0launched under President\u00a0Yudhoyono\u2019s Reducing\u00a0Emissions from\u00a0Deforestation and Forest\u00a0Degradation Plus (REDD+) program.<\/p>\n<p>The presidential instruction\u00a0on the ban was issued on May 20 last year.\u00a0There is also a law in place prohibiting new\u00a0concessions on land with peat layers more\u00a0than 3 meters deep.<\/p>\n<p>Nevertheless, Kallista Alam and Surya\u00a0Panen Subur (SPS) 2, another plantation\u00a0company, were given land concessions in\u00a0Tripa. A lawsuit fi led by Indonesia\u2019s largest\u00a0environmental group, Walhi, on November\u00a023 of last year to have that license revoked\u00a0was thrown out on April 2 this year by the\u00a0Banda Aceh Administrative Court. Walhi\u00a0has since appealed.<\/p>\n<p>Field checks and investigations carried\u00a0out this year by a joint team comprising the\u00a0Forestry Ministry, REDD+ Task Force and\u00a0the Environment Ministry found evidence\u00a0that the Tripa forests had not just been\u00a0cleared and replanted with palm oil plantations,\u00a0it had been burned, slashed and thoroughly\u00a0drained, thus gradually releasing\u00a0carbon dioxide.<\/p>\n<p>This joint investigation team first fl ew\u00a0into Aceh on May 4, accompanied by members\u00a0of the National Police and the Attorney\u00a0General\u2019s Offi ce. The team works under the\u00a0guidance of REDD+ task force chief Kuntoro\u00a0Mangkusubroto, who heads the Presidential\u00a0Unit for Development, Supervision and Oversight (UKP4),<\/p>\n<p>The Tripa peatland forest is now on the\u00a0brink of ruin. In the 1980s, this forest covered\u00a0no less than 62,000 hectares. Today,\u00a0it extends to no more than 17,000 hectares\u00a0and is continuing to decline. There are indications\u00a0of arson from incidents of recent\u00a0fires at the protected peat forest, according\u00a0to the Environment Ministry, with strong indications\u00a0that the perpetrators are companies\u00a0waiting to convert the forested regions\u00a0into palm oil plantations.<\/p>\n<p>Yet Tripa has been slotted back into the indicative\u00a0map, better known as the moratorium\u00a0map, this year. On May 21, UKP4\u00a0announced that an additional\u00a0379,000 hectares had been\u00a0added to the map. The protected\u00a0area covered in the\u00a0revision\u2014which is the second\u00a0since the ban came\u00a0into effect\u2014amounts to\u00a065.75 million hectares of\u00a0peatlands, primary forests\u00a0and conservation areas.<\/p>\n<p>The first revision of the\u00a0map was done on November\u00a020, 2011, and had come under intense\u00a0media scrutiny\u2014it had scrapped\u00a0the Tripa forest from the map. This was a\u00a0reason used by Kallista Alam to point out\u00a0that since Tripa had been taken off the\u00a0map, converting the forest into a plantation\u00a0on the basis of a permit issued by the\u00a0Aceh Governor was consistent with existing\u00a0regulations. However, the joint team investigating\u00a0the Tripa case learned eventually\u00a0that forest clearing activities by Kallista\u00a0Alam dated back to years before 2011.<\/p>\n<p>\u201cTripa is a protected zone\u2014it can no longer\u00a0be converted again,\u201d stated Kuntoro.\u00a0Tripa is spotlighted nationally because former\u00a0Aceh Governor Irwandi Yusuf\u2019s action\u00a0to go beyond the ban on issuing new clearing\u00a0permits had shocked many people. Irwandi,\u00a0once known as the \u2018Green Governor,\u2019\u00a0was at one time an environmental activist.<\/p>\n<p>In 2010, he received an award from\u00a0the Environment Ministry for his dedicated\u00a0work on environmental conservation.\u00a0Walhi refers to the Tripa forest scandal\u00a0as the face of other similar scandals happening\u00a0across forested regions in Indonesia,\u00a0one where even environmental activists\u00a0like Irwandi allow forest burnings to accommodate\u00a0palm oil and timber interests.\u00a0\u201cThis is the case to refer to when one wants\u00a0to portray the powers of collusion between\u00a0government officials and businessmen,\u201d\u00a0said Aceh Walhi Director T.M. Zulfikar.<\/p>\n<p>Some environmental activists allege that\u00a0the police and the military were behind\u00a0Kallista Alam. According to Halim Gurning\u00a0in Nagan Raya, the offi ce and lands of\u00a0Kallista Alam had always been secured by\u00a0armed police and military personnel, who\u00a0blocked residents and activists from entering\u00a0Kallista\u2019s lands. \u201cTheir commander\u00a0threatened us and his personnel placed our\u00a0offices under surveillance,\u201d said Halim.<\/p>\n<p>A Tempo source said evidence of the security\u00a0apparatus were still found when the\u00a0joint investigating team arrived at Tripa in\u00a0May. At the time, there were three security\u00a0guard posts. Mobile Brigade members occupied\u00a0the left cabin, soldiers were in the\u00a0middle and Nagan Raya policemen on the\u00a0right. In front of the three cabins there was\u00a0a signboard that read Pos TNI-Polisi (military\/police post). Besides the guard posts,\u00a0the investigating team found a military official car. But when Tempo visited Tripa two\u00a0weeks ago, all signs had been removed.<\/p>\n<p>The investigating team explained the five\u00a0violations that occurred in Tripa. They discovered\u00a0that Kallista Alam had systematically\u00a0cleared the land before obtaining the\u00a0license from former governor Irwandi. A\u00a0legal affairs staff member of Kallista Alam\u00a0admitted his company had started clearing\u00a0land at Tripa in 2009. A year later they began\u00a0to plant. The same admission was conveyed\u00a0by Kallista fi eld offi cers to Forestry\u00a0Minister Zulkifl i Hasan and Deputy Speaker\u00a0of the People\u2019s Consultative Assembly\u00a0(MPR) from Aceh, Farhan Hamid, who inspected\u00a0the location in May.<\/p>\n<p>Kallista had also cleared land through\u00a0slash-and-burn. According to an investigator,\u00a0burning land to clear it is cheaper. The\u00a0company spent Rp2 million per hectare\u00a0at most. Had they followed rules, the cost\u00a0would have been Rp60 million per hectare.<\/p>\n<p>Burning land is in violation of the Plantations\u00a0Law and the Environment Law. The investigating\u00a0team noted that the 1,605-hectare\u00a0land then owned and burned by Kallista\u00a0also falls within the Leuser Ecosystem,\u00a0which is already designated as a National\u00a0Strategic protected zone. Forest clearing\u00a0using fi res is punishable by 10 years in prison\u00a0and a fine of up to Rp10 billion.\u00a0Although the violations are apparent, no\u00a0one has been indicted. According to the Environment\u00a0Ministry\u2019s deputy for legal compliance,\u00a0Soedarjono, investigators have\u00a0only examined witnesses. A Kallista project\u00a0manager, Alvis, said his company had followed\u00a0all procedures to obtain land clearance\u00a0permits at Tripa. He said his company\u00a0should not be the only one accused for\u00a0the reduced peatland swamp. \u201cMany other\u00a0companies operate here,\u201d claimed Alvis.<\/p>\n<p>Irwandi has not yet been questioned. Since he lost in the recent Aceh gubernatorial\u00a0election, he spends his time in Malaysia.\u00a0He has insisted he had previously rejected\u00a0Kallista\u2019s permit application, on the\u00a0basis that Tripa was within the Leuser Ecosystem.\u00a0Irwandi signed off on the permit\u00a0after getting recommendations from various\u00a0parties, including the Regent of Nagan\u00a0Raya, the Forestry Offi ce and the Aceh Regional\u00a0Police. \u201cPersonally, I\u2019d prefer the license\u00a0to be revoked,\u201d said Irwandi, as quoted\u00a0by the June 20 issue of Modus Aceh weekly.\u00a0\u201cAt that time, I acted against my own\u00a0conscience.\u201d\u00a0<strong>UNTUNG WIDIANTO (ACEH), YOGITA MEHER,\u00a0JAJANG JAMALUDIN (JAKARTA)<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Tripa peat swamp, one of the largest capacities\u00a0storing carbon in Aceh, is near total ruin.
