He was paid 13 million rupiah (about US$883) to transport the exotic animals.<\/p>\n<p>Not long after he was caught, the leader of the syndicate, Irawan Shia, 42, and two other men named Asrin and Safrijal were arrested. Shia earned 40 million rupiah&nbsp;($2,728) for the deal, half of which was spent on courier fees.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/uploads.knightlab.com\/storymapjs\/75a9bc5c2cf93cdbaf23f76ceecef5fa\/the-journey-of-irawan-shias-syndicate\/index.html\" width=\"100%\" height=\"600\" frameborder=\"0\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p>On June 16 this year, the district court in Riau Province in Sumatra,&nbsp;used new legislation to impose an unprecedented jail sentence of four years, and a fine of one billion rupiah&nbsp;($68,000)&nbsp;on Irawan. His three accomplices&nbsp;were each sentenced to two years and six months imprisonment and fines of a similar value.<\/p>\n<p>\u201cThis is a wildlife-smuggling case with the biggest verdict ever,\u201d said Antonius Aditantyo Nugroho,&nbsp;a researcher at the Indonesian Centre for Environmental Law.<\/p>\n<h2><strong>Data trail<\/strong><\/h2>\n<p>Data from 29 wildlife-crime court rulings between January and August 2020 collated by&nbsp;<a href=\"https:\/\/docs.google.com\/spreadsheets\/d\/1JVIUFzBU6OiUTnNy_5Yr7PVGHOVbdUhhMsgxFDFMWUs\/edit?usp=sharing\">#WildEye<\/a>&nbsp;shows that more than 50 percent&nbsp;of convicted perpetrators were given suspended sentences of less than a year.<\/p>\n<p>A smuggler named Irfan was jailed for four years on April 1, 2020, after being convicted of smuggling more than 1,500 horseshoe crabs to Malaysia. However, the fine in that case was 100 million rupiah&nbsp;($6,800), and he was tried under different legislation.<\/p>\n<p>Seven of the 29 defendants were fined 10&nbsp;million rupiah, five received a fine of 50 million rupiah, and the other fines varied between one and 10-million rupiah. Irawan and his allies were the only defendants fined up to one billion rupiah.<\/p>\n<p>Two cases in 2019 captured the public\u2019s attention. The first was the smuggling of a baby orangutan by&nbsp;Russian citizen, Andrei Zhestkov, 28, via I Gusti Ngurah Rai Airport, in Denpasar, Bali,&nbsp;on March 22.&nbsp;<a href=\"https:\/\/putusan3.mahkamahagung.go.id\/direktori\/putusan\/9e33b702399394d030da389f570d129f.html\">Zhestkov anaesthetised the orangutan&nbsp;<\/a>and was transporting it to Russia in a rattan basket when he was arrested in Indonesia. The Denpasar District Court sentenced him to one year in jail and a fine of five million rupiah.<\/p>\n<p>The second case involved a skipper named&nbsp;<a href=\"https:\/\/putusan3.mahkamahagung.go.id\/direktori\/putusan\/b3506f4da4ea0f3af51bbd2053db5510.html\">Sukandar who was caught smuggling&nbsp;7,000 horseshoe crabs<\/a>. He was arrested in Malacca waters on his way to Satun Port, Thailand, to sell his&nbsp;wildlife. The Medan District Court sentenced him to one year and three months in jail&nbsp;and a fine of 50 million rupiah, on December 1, 2019.<\/p>\n<figure id=\"attachment_59068\" aria-describedby=\"caption-attachment-59068\" style=\"width: 760px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-59068\" src=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/sites\/6\/2020\/10\/1-leopard-cat-1024x683.jpg?resize=760%2C507&#038;ssl=1\" alt=\"\" width=\"760\" height=\"507\"><figcaption id=\"caption-attachment-59068\" class=\"wp-caption-text\">North Sumatra Conservation Agency officers release two confiscated leopard cats in the Sicike-Cike conservation forest area in April 2020. Credit: Septianda Perdana<\/figcaption><\/figure>\n<h2><strong>Quarantine Act<\/strong><\/h2>\n<p>So&nbsp;why were Irawan and his allies sentenced to a higher verdict than those imposed in the other cases? The answer, said Nugroho of the Indonesian Centre for Environmental Law, is the use of new laws.<\/p>\n<p>Previously, the public prosecutor used&nbsp;<a href=\"http:\/\/www.dpr.go.id\/dokjdih\/document\/uu\/602.pdf\">the Conservation Act<\/a>&nbsp;of 1990&nbsp;concerning the Natural Resources Conservation Agency&nbsp;to prosecute wildlife smugglers. This Act stipulates a maximum prison sentence of five years and a maximum fine of 100 million rupiah&nbsp;(about $6,800).<\/p>\n<p>In Irawan\u2019s case, the prosecutor used the 2019 Act concerning Animal, Fish, and Plant Quarantine (<a href=\"https:\/\/sipuu.setkab.go.id\/PUUdoc\/175977\/UU_Nomor_21_Tahun_2019.pdf\">the Quarantine Act<\/a>). This Act sets higher sentences, with a maximum jail term of 10 years and a fine of up to 10 billion rupiah (about $682,000).<\/p>\n<p>\u201cThis is the first smuggling case in Indonesia that used the 2019 Quarantine Act,\u201d said prosecutor Himawan Putra, who handled the&nbsp;Irawan case.<\/p>\n<p>The Quarantine Act, promulgated on October 18, 2019, focuses on the health sector. It was created to prevent the spread of pests, diseases and invasive agents, including the control of genetically modified products. It stipulates that wild animals and plants entering and leaving Indonesia must be reported to the Quarantine Agency, with supporting documents.<\/p>\n<p>The requirements for these supporting documents are set out in&nbsp;<a href=\"http:\/\/perundangan.pertanian.go.id\/admin\/file\/Permentan%2017-2017%20Dokumen%20Karantina%20Hewan.pdf\">the Minister of Agriculture Regulation\/KR.120\/5\/2017<\/a>. Article 12 of this regulation states that any animal entering Indonesian jurisdiction must be accompanied by several certificates, including certificates of veterinary health, sanitation and origin, documents approving&nbsp;the transportation of&nbsp;wildlife and those confirming that a product is halal.<\/p>\n<figure id=\"attachment_59074\" aria-describedby=\"caption-attachment-59074\" style=\"width: 800px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-59074\" src=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/2020\/10\/5-baby-leopard.jpg?resize=800%2C533&#038;ssl=1\" alt=\"\" width=\"800\" height=\"533\"><figcaption id=\"caption-attachment-59074\" class=\"wp-caption-text\">Two of the four African lion cubs rescued from the smuggling attempt by Irawan Shia\u2019s syndicate. Credit: Haluan Lampung<\/figcaption><\/figure>\n<h2><strong>Deterrent effect<\/strong><\/h2>\n<p>Irawan Shia\u2019s syndicate, which&nbsp;smuggled exotic and protected endangered animals, could not provide these documents. Putra said the prosecuting team deliberately charged Irawan and his aides using the Quarantine Act so the case would act as a precedent with a deterrent effect.<\/p>\n<p>The animals they were smuggling are not indigenous to Indonesia. \u201cThese animals [lions and leopards] are included in Appendix I of CITES, which means they cannot be traded if they come from the wild,\u201d said Gunawan, a researcher at the Riau Natural Resources Conservation Agency, who served as an expert witness in the trial.<\/p>\n<p>The Quarantine Act could provide a new pathway toward&nbsp;animal smuggling eradication. However, Nugroho said, the Act also has technical&nbsp;loopholes because it relies on the completeness of animal and plant certification documents. If these documents enable&nbsp;endangered species trading, then future cases might escape the legal snares.<\/p>\n<p>The 2019 Quarantine Act was also not the primary legal basis for biodiversity conservation, he said. There is still some legal vacuum in dealing with endangered species that are not protected, or non-native \u2013 for example, provisions regarding treatment mechanisms, repatriation, administrative sanctions&nbsp;and even funding.<\/p>\n<p>\u201cThere should be more insight and awareness among investigators, prosecutors, judges, and quarantine and customs officials so this law can serve as another approach to ensnare the illegal animal traders,\u201d added Nugroho.<\/p>\n<p><iframe style=\"width: 100%; height: 600px;\" src=\"https:\/\/flo.uri.sh\/visualisation\/3566283\/embed\" frameborder=\"0\" scrolling=\"no\" aria-label=\"\"><\/iframe><\/p>\n<div style=\"width: 100%!; margin-top: 4px!important; text-align: right!important;\"><a class=\"flourish-credit\" style=\"text-decoration: none!important;\" href=\"https:\/\/public.flourish.studio\/visualisation\/3566283\/?utm_source=embed&amp;utm_campaign=visualisation\/3566283\" target=\"_top\" rel=\"noopener noreferrer\"><img decoding=\"async\" style=\"width: 105px!important; height: 16px!important; border: none!important; margin: 0!important;\" src=\"https:\/\/public.flourish.studio\/resources\/made_with_flourish.svg\" alt=\"Made with Flourish\"> <\/a><\/div>\n<p>&nbsp;<\/p>\n<h2><strong>Outdated law<\/strong><\/h2>\n<p>One of the main obstacles to&nbsp;eradicating the illegal animal trade in Indonesia has been ineffective law enforcement, Nugroho said. Investigators and prosecutors were still using the Conservation Act, issued 30 years ago, and as a result the punishment for perpetrators was too lenient.<\/p>\n<p>Between 2009 and 2019 the Indonesian Centre for Environmental Law&nbsp;<a href=\"https:\/\/icel.or.id\/wp-content\/uploads\/2019-Arah-Baru-Kebijakan-Penegakan-Hukum-Konservasi-v2.pdf\">collected 150 court<\/a>&nbsp;rulings related to wildlife crimes involving 195 defendants. Analysis showed the prosecution asked for an average prison term of one year and three months and an average fine of 18.6 million rupiah. The verdicts of the panel of judges presiding in the cases was slightly lower, with an average imprisonment of 8.1 months and a fine of 14.3 million rupiah.<\/p>\n<p>The highest jail term in these cases was handed down to Sabian, a farmer in Bengkulu who was convicted in connection with illegally trading tiger skin and bones, and was&nbsp;<a href=\"https:\/\/putusan3.mahkamahagung.go.id\/direktori\/putusan\/5d210490be415450fd9ebbbe0d159f27.html\">sentenced<\/a>&nbsp;to four years in prison and a fine of 50 million rupiah. Only in eight different cases was the maximum fine of 100 million rupiah&nbsp;imposed by the judges.<\/p>\n<p>\u201cThe 1990 Conservation Act is arguably outdated,\u201d said Irma Hermawati, an independent legal expert on wildlife laws.<\/p>\n<p>Another shortfall of the 1990 Conservation Act, she said, is that it can only be used to prosecute individuals, not legal entities, corporations, or syndicated organisations. Cases involving smuggling syndicates, such as in Irawan Shia\u2019s case, were handled individually.<\/p>\n<p>The 1990 Conservation Act needed to be revised for the courts to implement effective legal action, Hermawati said. Though the Quarantine Act provided for higher punishment, its application was restricted and would be difficult to implement in cases such as online animal trafficking or wildlife killing.<\/p>\n<figure id=\"attachment_59067\" aria-describedby=\"caption-attachment-59067\" style=\"width: 760px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-59067\" src=\"https:\/\/i0.wp.com\/www.ekuatorial.com\/wp-content\/uploads\/sites\/6\/2020\/10\/4-pangolin-1024x683.jpg?resize=760%2C507&#038;ssl=1\" alt=\"\" width=\"760\" height=\"507\"><figcaption id=\"caption-attachment-59067\" class=\"wp-caption-text\">Pangolins rescued from the illegal trade by the North Sumatra Conservation Agency. Credit: Septianda Perdana<\/figcaption><\/figure>\n<h2><strong>Dead end<\/strong><\/h2>\n<p>Efforts to reform the 1990 Conservation Act have been made repeatedly. A<a href=\"https:\/\/wikidpr.org\/ruu\/ruu-perubahan-atas-uu-no-5-tahun-1990-tentang-konservasi-sumber-daya-alam-hayati-dan-ekosistemnya\">&nbsp;substitute bill&nbsp;<\/a>was included in the 2015-2019 National Legislation Programme, and was proposed by the House of Representatives. The academic manuscript was&nbsp;prepared and submitted to the government on December 6, 2017.<\/p>\n<p>However, discussions about the Conservation Bill review were continuously hampered. The Ministry of Environment and Forestry, the government\u2019s representatives and the House of Representatives could not agreed on several matters \u2013 among them the basic philosophy of conservation.<\/p>\n<p>The academic manuscript of the Conservation Bill that was filed by the House of Representatives contained a change in the concept of conservation to \u201cprotection, utilisation, and recovery.&#8221;&nbsp;But according to the Minister of Environment and Forestry, Siti Nurbaya, the universal basic concept adopted from the World Conservation Strategy was \u201cprotection, preservation, and utilisation.\u201d<\/p>\n<p>The proposed bill also separated&nbsp;conservation areas into water and land, and said&nbsp;conservation must be treated from the perspective of a whole area in an interconnected ecosystem.<\/p>\n<p>Another crucial stumbling block was the provision&nbsp;for the use of conservation areas by corporations, both state and private. This provision contradicted the 1945 Indonesian Constitution, which stipulates&nbsp;that natural resources are controlled by the country and used as widely as possible for people\u2019s prosperity.<\/p>\n<p>\u201cThe government considers that fundamental deepening is still needed, especially related to the philosophy of conservation and ecological principles, as well as concerning constitutionality and its implementation,\u201d&nbsp;<a href=\"http:\/\/ppid.menlhk.go.id\/siaran_pers\/browse\/1744\">wrote the Ministry of Environment and Forestry<\/a>&nbsp;in response to the Conservation Bill.<\/p>\n<p>After several encounters, the government officially withdrew from the Conservation Bill discussion. A letter was sent by the Minister of Environment and Forestry to the head of the House of Representatives on May 24, 2019, requesting an end to the Conservation Bill discussions.<\/p>\n<p>Wiratno, the General Director of Conservation of Natural Resources and Ecosystems for the Ministry of Environment and Forestry, told #WildEye that the 1990 Conservation Act is still adequate to arrest and prosecute the perpetrators of animal crimes.<\/p>\n<p>\u201cThere were perpetrators who got sentenced to three or four years in jail. This depends on negotiations with law enforcement officials. We got a lot of support from the police,\u201d he said.<\/p>\n<p>However, #WildEye\u2019s data indicates only a fraction of the perpetrators were given the maximum sentence. Most of them enjoyed liberty and income from their crimes after serving several months in prison.<\/p>\n<p>Moreover, the maximum fine of 100 million rupiah&nbsp;stipulated in the 1990 Conservation Act was far less than the profits the perpetrators gained from animal trafficking, said Hermawati.<\/p>\n<p>\u201cThe profits they get from animal trafficking are enormous.
